Please read the Terms and Conditions as they govern the usage of the Sleepandshade, website and affiliate services. The terms may be changed over time, and it is your responsibility to regularly check for updates. By placing an order, you are deemed to have agreed to the latest Terms and Conditions posted on the website.

 

ELIGIBILITY

To use the website, you must be at least 18 years old, capable of lawful payment, agree to the Terms and Conditions, and be able to enter binding orders. We reserve the right to decline orders suspected of commercial usage.

 

PAYMENT

Sleepandshade.com accepts various payment methods, including Visa, Mastercard, Cash on Delivery, Apple Pay, & installment options. Payment is taken upon order placement, and we reserve the right to decline orders if payments are not authorized.

 

PRICES

Prices are displayed in AED and may exclude additional costs. If paid in a foreign currency, the exchange rate of your card issuer applies.

 

COPYRIGHTS AND INTELLECTUAL PROPERTY

All intellectual property rights on the Sleep and Shade website remains our property. The content is protected by copyright laws. All rights are reserved.

QUALITY ASSURANCE, WARRANTY AND RETURNS

All items must be checked at the time of delivery by the Client and approved after which any damages will not be the responsibility of the Company.

A warranty period of 30 days is provided for all items which covers:

• Structural failure (purely manufacturing failure)
• Seam separation
• Broken zippers or buttons
• Cracking, bubbling or peeling finish
• Broken structures of furniture pieces

This warranty does not cover damages resulting from:

• Damages incurred during delivery by shipping company.
• Normal wear and tear.
• Abuse, misuse, or accident (including, without limitation, use of product in unsuitable environments or conditions).
• Damage or marking of materials or scrape of fabric over time caused by sharp or foreign objects.
• Alteration or modification of the product.
• Change of color of fabrics and surface materials due to soiling, stains, or dye transfer from clothing, including denim.
• This warranty specifically excludes coverage of damage related to climate conditions including heat, light, and humidity levels, such as fading, color change, stretching, or shrinking.
• Company expressly disclaims any liability to customers or end users of its products for special, incidental or consequential damages including damage to or loss of other property or equipment, personal injury, or cost of other damages arising out of or in any way connected with the sale or use of its products. The maximum liability if any, of company for any damages hereunder is limited to the purchase price of the defective or non-conforming products sold pursuant to this transaction. Any action arising hereunder must be brought within the warranty period from the date of sale.

Our motorised curtain mechanism comes with a 5-Year Limited Warranty.

Hence, each claim will be assessed case by case. In the instance the item needs to return to the factory for checking or fixing, courier charges will be borne by client until the item is checked and confirmed to be covered under warranty after which the courier charges will be reversed.

c. Once an order has been confirmed and the transaction has been processed, we cannot accept any cancellations of the order.

We understand that flexible policies are important to you. However, we reserve the right to approve returns or exchanges, based on the condition of the piece and customer account history. Shipping fees and all transactional fees are non-refundable.

Unfortunately, we do not offer returns on any products across our site. Each piece is made to order, meaning each piece is custom made especially just for you. Make sure you have checked all sizes and materials beforehand.

In the rare case that a product or piece has one of more of the following issues, we will offer immediate resolutions on a case-by-case basis, and in a timely manner. We know what it’s like not to be satisfied.

• The wrong product was sent to you.
• The product is defective.
• The product has arrived to you damaged.

Each order that leaves our warehouse undergoes a complete inspection so that it arrives to you safely and proper. If there are any damages on the furniture photographs must be taken and shared with us at the time of delivery or within 24 hours of delivery to be rectified/replaced. After that claims will not be accepted. If this is the case, you are within your rights to refuse the product.

Any agreed refunds will be done only through the Original Mode of Payment, Refunds will be made back to the payment solution used initially by the customer. Please allow for up to 45 days for the refund transfer to be completed in case of damaged product.

GOVERNING LAW

These Terms & Conditions and the transactions contemplated hereby shall be governed by and construed and interpreted in accordance with the Laws of United Arab Emirates, without regard to the principle of conflict of laws. Any actions seeking legal or equitable relief arising out of or relating to these terms will be brought only in the Court of the United Arab Emirates.

AMENDMENTS

The Company reserves the right to amend these terms and conditions at any time. Any amendments will be effective upon notification to the customer.

FORCE MAJEURE

The Company is not liable for any delay or failure to perform its obligations under these terms and conditions due to circumstances beyond its reasonable control, including but not limited to acts of God, war, strikes, or governmental actions.

 

LIMITATION OF LIABILITY

The Company explicitly disclaims any liability to customers or end users for special, incidental, or consequential damages, including damage to or loss of other property or equipment, personal injury, or the cost of other damages arising out of or in any way connected with the sale or use of its products. The maximum liability, if any, of the Company for any damages hereunder is limited to the purchase price of the defective or non-conforming products sold pursuant to this transaction.
